IIDs are becoming an increasingly popular penalty imposed by judges as part of DUI probation. Essentially a mini-Breathalyzer that must be professionally installed on the steering column of every car owned by the probationer, the IID operates to prevent the car from starting unless and until an alcohol-free breath sample is provided. Subsequently, random samples are requested while the vehicle is in operation.
Mandatory IIDs for Some First Time DUI
Generally speaking, the installation of an IID for a first DUI is rare, but it may be mandatory depending on your location. Responding to increased pressure from such organizations as Mothers Against Drunk Driving, the California legislature passed a bill requiring mandatory IIDs for all first time offenders in four counties. Consequently, if you live in Los Angeles County, for example, an IID will be necessary, but if you live in say Orange, Riverside or San Bernardino Counties, the judge will decide on a case-by-case basis. Originally set to expire in January, 2016, the program was extended through July, 2017.
Will Mandatory be the New Norm?
Under SB 1046, a proposed bill wending its way through the legislature, California would become the 26th state nationwide to require IIDs for all convicted of drunk driving. Its future will likely depend primarily on the statistical analysis of the data gathered reporting the effectiveness in the pilot program’s deterrence of drunk driving in the four designated counties.
Current Law
Although each judge has wide discretion in determining an appropriate punishment, an IID is rare for a first time offender unless a BAC of 0.15 or greater is reported or a refusal is involved. When installed, the IID may be required for up to three years. For the four pilot program counties, most first time offenders must maintain the IID for a five month period, with judges ordering repeat offenders to require IIDs for correspondingly lengthier periods.
IID Requirements
As a condition of having your driver’s license reinstated, you will be required to have an IID installed but only by a court-approved vendor. The cost varies, but anywhere between $75-100 is typical, although certain luxury vehicles may be costlier. Additionally, there are daily fees to operate the IID, as well as maintenance and calibration that may require you to bring the vehicle to a designated service facility. Each car you own must be so equipped, but if you can demonstrate financial hardship, you may be responsible for only a portion of the total IID costs.
