California Speed Law
There are a number of different California speed laws that you can be cited for. In this blog, we will explore one specific California speed law: Vehicle Code 22350.
What Does The Law Say?
Vehicle Code 22350 says “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
What Does This Mean?
In summation, you are required to drive at a safe speed under the conditions of the road. For example, if you are driving fifty (50) mph on a road that limits speed at forty (40) mph, then you may or may not be in violation. In order to find one in violation under this scenario, you need to look at other factors including but not limited to the amount of traffic, weather conditions, visibility, etc. After considering these factors, you can likely come to a conclusion if you violated the law.
Trial
In the event that your case goes to trial, all elements of the alleged speeding violation must be proven. The evidence must be substantial and show that you drove at a speed that endangered people or property or that the driver drove at a speed that was unreasonable for the driving conditions. Upon satisfying the above, you can be convicted of speeding under VC 22350.
